So many businesses shut down by government mandate without redress. This 4th of July should be less of a celebration and more of a reminder that very little of what our forefathers fought for is still protected today.”

We are shocked, saddened and sickened by the courts judgement. I received this message this morning from a player who lives in our neighborhood who is quite well known in the USA.

As most of you know we have endured terror, vandalism to our ranch and have been shot up by a small few in our neighborhood since the day we opened in July of 2020. Below is a summary of the past 3 years.

A cease-and-desist letter was sent in July 2020 to simply stop our commercial business as they claimed that no businesses are allowed to operate in our neighborhood under the deed restrictions. There are hundreds of businesses big and small inside in our neighborhood and I tried to work with this small group but they would have nothing with this. No businesses period can operate. That is when the terror campaign against me and my family began.

In order to put a stop on the harassment and terror and ultimately to put the “business” question to rest we filed a law suit in September 2020 to those named in the letter. We also over the next 6 months installed dozens of state-of-the-art security video surveillance cameras to monitor our ranch and try to make sense of what we were facing.

In April 2021, we won a summary judgement that allowed us to operate our business under the existing ill devised deed restrictions so long as we were not an annoyance or nuisance to the neighborhood and that we were not noxious or offensive. The small few who “ruled” the neighborhood could no longer wield their might for neighbors simply having a business.

As we are two padel courts on 15 acres of land and our closest neighbors being a far distance away we felt comfortable that we would be able to serve our community and their padel fitness needs with ease.

The deed restrictions itself was so poorly written and as we uncovered during this process 100% of every home owner violates at least one restriction and 75% violate many more restrictions including the defendants themselves.

We had confidence in the summary judgement win and in May 2021 we tried to sever our law suit. We would be 2 padel courts forever. Our “test kitchen” to help grow padel in the USA survived. The defendants would not have this as they wanted us gone no matter what. So, they argued that the courts must weigh in on the question of waiver for these deed restrictions. We were shocked as everyone violates some or all of the deed restrictions. As the expert on deed restrictions testified at trial, “I have never seen so many violations in my 20 plus years in this business. I stopped counting after 180 violations”

After this summary judgement win, the harassment and terror persisted to where I thought my life was at risk. One of the defendants was so aggressive towards me personally, I issued a Texas Peace Bond so that he would not harm me, my family or our property. This Peace Bond was not awarded as the judge asked me if he had harmed me physically? Although, we had evidence of his flying a drone unto our property and had stacks of evidence of his verbal abuse because he had not yet physically harmed me then the presiding Judge could not issue the Peace Bond. I was not trying to attain a restraining order but simply a civil peace bond to assure that I was not harmed in the future so I am still confused to this day as to what a Texas Peace Bond is designed for. I was disappointed but the defendant did slow down his terror against me after this.

From May 2021 to January of 2023, the harassment and terror rained down on a daily basis. Our padel family was our pillar of strength through this and we are thankful for our padel family.
